Datenschutzerklärung
1. Verantwortliche Stelle
DxVida GmbH i. G., Großenhainer Straße 98, 01127 Dresden, Deutschland, vertreten durch die Geschäftsführerin Priscilla Hidalgo Solis. E-Mail: phidalgosol@gmail.com. Wenn auf dieser Website „ich“ steht, ist Priscilla Hidalgo Solis gemeint, die für die DxVida GmbH i. G. handelt. Einen Datenschutzbeauftragten haben wir nicht benannt, weil dafür keine Pflicht besteht (§ 38 BDSG); bei allen Fragen zum Datenschutz schreiben Sie mir direkt.
2. Grundsatz
Diese Website verwendet keine Cookies, keine Analyse- und keine Tracking-Dienste. Es werden keine Nutzungsprofile erstellt. Der Mental-Load-Rechner und der Drei-Minuten-Check laufen vollständig in Ihrem Browser; Ihre Eingaben verlassen Ihr Gerät nur, wenn Sie ein Formular absenden (Abschnitt 5). Schriften werden von diesem Server geladen, nicht von Google oder anderen Anbietern. Links zu Instagram, LinkedIn, Substack, Google Präsentationen und anderen Plattformen sind einfache Links: Auf dieser Website sind keine Inhalte dieser Plattformen eingebettet, und es fließen keine Daten an sie, bevor Sie einen Link anklicken. Nach dem Klick gilt die Datenschutzerklärung der jeweiligen Plattform.
3. Speicherung auf Ihrem Gerät
Diese Website legt nur dann etwas auf Ihrem Gerät ab, wenn Sie selbst eine Einstellung wählen, und zwar im Local Storage Ihres Browsers:
- „site-lang“: die Sprache, die Sie auf dieser Website gewählt haben;
- „curso_lang“ und „curso_done“: im Kursbereich die gewählte Sprache und die Module, die Sie als erledigt markiert haben.
Diese Einträge enthalten nur einen Sprachcode bzw. eine Liste von Modulkennungen, bleiben auf Ihrem Gerät und werden weder an mich noch an Dritte übertragen. Sie sind unbedingt erforderlich, damit die von Ihnen ausdrücklich gewünschte Funktion (Sprache beibehalten, Kursfortschritt merken) funktioniert (§ 25 Abs. 2 Nr. 2 TDDDG); eine Einwilligung ist dafür nicht nötig. Sie bleiben gespeichert, bis Sie die Websitedaten in Ihrem Browser löschen.
4. Hosting und Übermittlung in die USA
Diese Website wird bei Netlify, Inc., 512 2nd Street, Suite 200, San Francisco, CA 94107, USA, gehostet. Beim Aufruf jeder Seite verarbeitet Netlify die technisch notwendigen Verbindungsdaten, insbesondere IP-Adresse, Zeitpunkt, aufgerufene Adresse, Referrer und Browserkennung (User-Agent), um die Website auszuliefern und vor Angriffen zu schützen. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO; mein berechtigtes Interesse ist eine sichere und funktionsfähige Bereitstellung der Website. Netlify speichert diese Protokolldaten nur so lange, wie es für diese Zwecke erforderlich ist.
Netlify handelt als Auftragsverarbeiter auf Grundlage seines Auftragsverarbeitungsvertrags (Art. 28 DSGVO), der Bestandteil der Nutzungsbedingungen ist. Netlify verarbeitet Daten auch in den USA. Netlify, Inc. ist nach dem EU-U.S. Data Privacy Framework zertifiziert; die Übermittlung stützt sich auf den Angemessenheitsbeschluss der EU-Kommission vom 10. Juli 2023 (Art. 45 DSGVO). Für den Fall, dass dieser Beschluss entfällt, sind im Auftragsverarbeitungsvertrag die Standardvertragsklauseln der EU-Kommission vereinbart (Art. 46 Abs. 2 lit. c DSGVO). Die Zertifizierung können Sie unter dataprivacyframework.gov prüfen; eine Kopie der Standardvertragsklauseln schicke ich Ihnen auf Anfrage.
5. Kontakt- und Anfrageformulare, Drei-Minuten-Check, DxVida-Routenfrage
Was übermittelt wird. Wenn Sie ein Formular absenden, übermittelt Ihr Browser Ihre Angaben an Netlify Forms (Netlify, Inc., Abschnitt 4). Dort werden sie gespeichert, und ich werde per E-Mail benachrichtigt (Abschnitt 7). Je nach Formular sind das:
- Gespräch „Bring me one problem“ (Startseite und Seite „Whatever you need“): Name, E-Mail-Adresse, Ihr Anliegen, Anzahl der betroffenen Menschen, gewünschter Zeitraum, das Thema, über das Sie gekommen sind, und, falls Sie vorher den Check gemacht haben, dessen Stufe und Punktzahl. Beides sehen Sie vor dem Absenden im Formular und können es entfernen.
- Kursanfrage (KI-Kurs): Name, E-Mail-Adresse, ob es um ein Team oder Sie selbst geht, ungefähre Personenzahl, Standorte, Kurssprache und Ihr Ziel.
- LightenAI-Anfrage (Mental Load): Name, E-Mail-Adresse, Ihre Nachricht und das Ergebnis des Rechners (Betrag pro Monat).
- Drei-Minuten-Check: Ihre acht Antworten, Stufe und Punktzahl, E-Mail-Adresse, freiwillig Ihr Vorname, Ihre Einwilligung und ob Sie zusätzlich den Brief möchten. Übermittelt wird nur, wenn Sie eine E-Mail-Adresse eintragen und absenden; lassen Sie das Feld leer, verlässt nichts Ihren Browser.
- DxVida-Routenfrage: Herkunfts- und Zielland, Warenkategorie, Ihre Rolle und, nur wenn Sie möchten, Ihre E-Mail-Adresse mit Ihrer Einwilligung.
Bei allen Formularen wird die Seitensprache mitgesendet, beim Gespräch und beim Check außerdem, über welchen Link Sie zum Formular gekommen sind (z. B. eine Schaltfläche auf dieser Website oder ein weitergeleiteter Check-Link). Netlify speichert zu jeder Einsendung automatisch Ihre IP-Adresse, die Browserkennung (User-Agent), die Adresse der absendenden Seite und den Zeitpunkt. Bitte schreiben Sie in Freitextfelder keine Angaben zu Ihrer Gesundheit oder zu der anderer Menschen; ich brauche sie nicht, um Ihnen zu antworten.
Spam-Prüfung. Netlify prüft jede Einsendung automatisch mit dem Dienst Akismet der Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA. Dafür werden die Formularinhalte zusammen mit IP-Adresse und Browserkennung an Akismet übermittelt. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO; mein berechtigtes Interesse ist der Schutz vor massenhaften missbräuchlichen Einsendungen. Die Weitergabe an Akismet erfolgt durch Netlify innerhalb der USA; Netlify ist dabei an die Regeln des EU-U.S. Data Privacy Framework für Weiterübermittlungen gebunden.
Wofür und auf welcher Grundlage.
- Gespräch, Kursanfrage und LightenAI-Anfrage: um Ihre Anfrage zu beantworten und, wenn Sie es wünschen, ein Angebot vorzubereiten (Art. 6 Abs. 1 lit. b DSGVO). Zielt Ihre Anfrage nicht auf einen Vertrag, stützt sich die Antwort auf mein berechtigtes Interesse, Anfragen zu beantworten (Art. 6 Abs. 1 lit. f DSGVO).
- Drei-Minuten-Check: um Ihnen einmal persönlich zu Ihrem Ergebnis zu schreiben, auf Grundlage Ihrer Einwilligung (Art. 6 Abs. 1 lit. a DSGVO).
- DxVida-Routenfrage: ohne E-Mail-Adresse, um zu sehen, welche Handelsrouten gefragt sind, und DxVida danach weiterzuentwickeln (Art. 6 Abs. 1 lit. f DSGVO; berechtigtes Interesse an der Produktplanung). Mit E-Mail-Adresse, um Ihnen zu schreiben, sobald Ihre Route in DxVida verfügbar ist, auf Grundlage Ihrer Einwilligung (Art. 6 Abs. 1 lit. a DSGVO).
Name und E-Mail-Adresse sind beim Gespräch, bei der Kurs- und bei der LightenAI-Anfrage Pflichtfelder, weil ich Ihnen sonst nicht antworten kann; alle anderen Angaben sind freiwillig. Eine gesetzliche oder vertragliche Pflicht, ein Formular auszufüllen, besteht nicht. Eine automatisierte Entscheidung im Sinne von Art. 22 DSGVO findet nicht statt; die Punktzahl des Checks berechnet Ihr Browser, und sie hat keine Folgen für Sie.
Wie lange. Anfragen und Check-Einsendungen lösche ich in Netlify und in meinem Postfach, sobald die Unterhaltung beendet ist, spätestens nach zwölf Monaten. Routenangaben mit E-Mail-Adresse lösche ich, sobald ich Ihnen geschrieben habe oder Sie Ihre Einwilligung widerrufen, Routenangaben ohne E-Mail-Adresse spätestens nach zwölf Monaten. Wird aus einer Anfrage ein Auftrag, bewahre ich die geschäftliche Korrespondenz so lange auf, wie handels- und steuerrechtliche Fristen es verlangen (§ 257 HGB, § 147 AO; für Geschäftsbriefe in der Regel sechs Jahre).
6. Der gelegentliche Brief
Für den Brief brauche ich nur Ihre E-Mail-Adresse. Sie können sich über das Formular in der Fußzeile oder über das Häkchen im Drei-Minuten-Check anmelden; Rechtsgrundlage ist Ihre Einwilligung (Art. 6 Abs. 1 lit. a DSGVO). Bevor der erste Brief kommt, erhalten Sie eine E-Mail, in der Sie Ihre Anmeldung bestätigen; ohne Bestätigung trage ich Sie nicht ein und lösche die Anmeldung. Anmeldung und Bestätigung speichere ich mit Zeitpunkt, um Ihre Einwilligung nachweisen zu können (Art. 7 Abs. 1 DSGVO). Den Brief versende ich über mein E-Mail-Postfach (Abschnitt 7). Sie können Ihre Einwilligung jederzeit widerrufen, über den Abmeldehinweis in jedem Brief oder formlos per E-Mail. Danach lösche ich Ihre Adresse aus der Versandliste; den Nachweis Ihrer Einwilligung bewahre ich bis zu drei Jahre auf, um mich gegen mögliche Ansprüche verteidigen zu können (Art. 6 Abs. 1 lit. f DSGVO).
7. E-Mail
Benachrichtigungen über Formulareinsendungen, Ihre E-Mails an mich, meine Antworten und der Brief laufen über mein E-Mail-Postfach bei Google (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland). Google kann Daten auch in die USA übermitteln; Google LLC ist nach dem EU-U.S. Data Privacy Framework zertifiziert (Art. 45 DSGVO).
8. Ihre Rechte
Sie haben das Recht auf Auskunft (Art. 15 DSGVO), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18) und Datenübertragbarkeit (Art. 20). Eine erteilte Einwilligung können Sie jederzeit mit Wirkung für die Zukunft widerrufen (Art. 7 Abs. 3 DSGVO); die bis dahin erfolgte Verarbeitung bleibt rechtmäßig. Eine formlose E-Mail genügt.
Widerspruchsrecht (Art. 21 DSGVO). Soweit ich Daten auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO verarbeite (Hosting, Spam-Prüfung, Routenfrage ohne E-Mail-Adresse, Anfragen ohne Vertragsbezug), können Sie aus Gründen, die sich aus Ihrer besonderen Situation ergeben, jederzeit widersprechen. Ich verarbeite die Daten dann nicht mehr, es sei denn, ich kann zwingende schutzwürdige Gründe nachweisen, die Ihre Interessen überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen.
Beschwerderecht (Art. 77 DSGVO). Sie können sich bei einer Datenschutz-Aufsichtsbehörde beschweren, insbesondere in dem Mitgliedstaat Ihres Aufenthaltsorts oder Arbeitsplatzes. Privacy notice
1. Controller

Where this website says "I", it means Priscilla Hidalgo Solis acting for DxVida GmbH i. G. We have not appointed a data protection officer because there is no obligation to do so (§ 38 BDSG); write to me directly with any privacy question.
2. The principle
This website uses no cookies, no analytics and no tracking services. No usage profiles are created. The Mental Load calculator and the three-minute check run entirely in your browser; your entries leave your device only when you send a form (section 5). Fonts are loaded from this server, not from Google or other providers. Links to Instagram, LinkedIn, Substack, Google Slides and other platforms are plain links: no content from these platforms is embedded on this website, and no data flows to them before you click a link. After the click, that platform's privacy policy applies.
3. Storage on your device
This website stores something on your device only when you choose a setting yourself, in your browser's local storage:
- "site-lang": the language you chose on this website;
- "curso_lang" and "curso_done": in the course area, the language you chose and the modules you marked as done.
These entries contain only a language code or a list of module identifiers, stay on your device and are not transmitted to me or to third parties. They are strictly necessary for the function you explicitly asked for (keeping your language, remembering your course progress) (§ 25 (2) no. 2 TDDDG); no consent is required. They remain until you delete the website data in your browser.
4. Hosting and transfer to the USA
This website is hosted by Netlify, Inc., 512 2nd Street, Suite 200, San Francisco, CA 94107, USA. When any page is opened, Netlify processes the technically necessary connection data, in particular IP address, time, requested address, referrer and browser identifier (user agent), to deliver the website and protect it against attacks. The legal basis is Art. 6 (1) (f) GDPR; my legitimate interest is a secure and working website. Netlify keeps these logs only as long as needed for these purposes.
Netlify acts as a processor under its data processing agreement (Art. 28 GDPR), which forms part of its terms of service. Netlify also processes data in the USA. Netlify, Inc. is certified under the EU-U.S. Data Privacy Framework; the transfer relies on the European Commission's adequacy decision of 10 July 2023 (Art. 45 GDPR). Should that decision lapse, the data processing agreement includes the European Commission's standard contractual clauses (Art. 46 (2) (c) GDPR). You can check the certification at dataprivacyframework.gov; I will send you a copy of the standard contractual clauses on request.
5. Contact and enquiry forms, the three-minute check, the DxVida route question
What is transmitted. When you send a form, your browser transmits your entries to Netlify Forms (Netlify, Inc., section 4). They are stored there, and I am notified by email (section 7). Depending on the form, this is:
- Conversation "Bring me one problem" (homepage and the "Whatever you need" page): name, email address, your request, the number of people involved, the preferred time frame, the topic you came through and, if you took the check before, its level and score. You see both in the form before sending and can remove them.
- Course enquiry (AI course): name, email address, whether it is for a team or for you, approximate number of people, locations, course language and your goal.
- LightenAI enquiry (Mental Load): name, email address, your message and the calculator result (amount per month).
- Three-minute check: your eight answers, level and score, email address, optionally your first name, your consent and whether you also want the letter. It is transmitted only if you enter an email address and send it; if you leave the field empty, nothing leaves your browser.
- DxVida route question: country of origin and destination, product category, your role and, only if you wish, your email address with your consent.
All forms send the page language; the conversation and the check also send which link brought you to the form (for example a button on this website or a forwarded check link). With every submission Netlify automatically stores your IP address, browser identifier (user agent), the address of the sending page and the time. Please do not write anything about your health or other people's health in free-text fields; I do not need it to answer you.
Spam check. Netlify checks every submission automatically with the Akismet service of Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA. For this, the form contents are transmitted to Akismet together with the IP address and browser identifier. The legal basis is Art. 6 (1) (f) GDPR; my legitimate interest is protection against large-scale abusive submissions. Netlify passes the data to Akismet within the USA and is bound by the EU-U.S. Data Privacy Framework rules for onward transfers.
Purpose and legal basis.
- Conversation, course enquiry and LightenAI enquiry: to answer your request and, if you wish, prepare a proposal (Art. 6 (1) (b) GDPR). If your request is not aimed at a contract, the answer relies on my legitimate interest in answering enquiries (Art. 6 (1) (f) GDPR).
- Three-minute check: to write to you once personally about your result, based on your consent (Art. 6 (1) (a) GDPR).
- DxVida route question: without an email address, to see which trade routes are in demand and develop DxVida accordingly (Art. 6 (1) (f) GDPR; legitimate interest in product planning). With an email address, to write to you once your route is available in DxVida, based on your consent (Art. 6 (1) (a) GDPR).
Name and email address are required for the conversation, the course enquiry and the LightenAI enquiry, because otherwise I cannot answer you; all other information is voluntary. There is no legal or contractual obligation to fill in a form. No automated decision within the meaning of Art. 22 GDPR takes place; your browser calculates the check score, and it has no consequences for you.
How long. I delete enquiries and check submissions in Netlify and in my mailbox once the conversation has ended, at the latest after twelve months. I delete route entries with an email address once I have written to you or you withdraw your consent, and route entries without an email address after twelve months at the latest. If an enquiry becomes an order, I keep the business correspondence as long as commercial and tax law require (§ 257 HGB, § 147 AO; usually six years for business letters).
6. The occasional letter
For the letter I need only your email address. You can sign up through the form in the footer or the tick box in the three-minute check; the legal basis is your consent (Art. 6 (1) (a) GDPR). Before the first letter arrives, you receive an email in which you confirm your sign-up; without confirmation I do not add you and I delete the sign-up. I store the sign-up and the confirmation with a timestamp to be able to prove your consent (Art. 7 (1) GDPR). I send the letter from my email mailbox (section 7). You can withdraw your consent at any time, through the unsubscribe note in every letter or informally by email. I then delete your address from the mailing list; I keep proof of your consent for up to three years to defend against possible claims (Art. 6 (1) (f) GDPR).
7. Email
Notifications about form submissions, your emails to me, my replies and the letter run through my email mailbox at Google (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). Google may also transfer data to the USA; Google LLC is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR).
8. Your rights
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20). You can withdraw any consent at any time with effect for the future (Art. 7 (3) GDPR); processing until then remains lawful. An informal email is enough.
Right to object (Art. 21 GDPR). Where I process data on the basis of Art. 6 (1) (f) GDPR (hosting, spam check, the route question without an email address, enquiries not aimed at a contract), you can object at any time on grounds relating to your particular situation. I will then stop processing the data unless I can demonstrate compelling legitimate grounds that override your interests, or the processing serves the establishment, exercise or defence of legal claims.
Right to lodge a complaint (Art. 77 GDPR). You can complain to a data protection supervisory authority, in particular in the member state where you live or work. The authority responsible for us is the Saxon Data Protection and Transparency Commissioner (Sächsische Datenschutz- und Transparenzbeauftragte), Maternistraße 17, 01067 Dresden (postal address: Postfach 11 01 32, 01330 Dresden), www.datenschutz.sachsen.de.

Esta web no usa cookies, ni servicios de analítica ni de seguimiento. No se crean perfiles de uso. La calculadora de carga mental y el check de tres minutos funcionan por completo en su navegador; sus datos solo salen de su dispositivo cuando usted envía un formulario (sección 5). Las fuentes se cargan desde este servidor, no desde Google ni otros proveedores. Los enlaces a Instagram, LinkedIn, Substack, Presentaciones de Google y otras plataformas son enlaces simples: en esta web no hay contenido incrustado de esas plataformas y no les llega ningún dato antes de que usted haga clic. Después del clic se aplica la política de privacidad de cada plataforma.
3. Almacenamiento en su dispositivo
Esta web solo guarda algo en su dispositivo cuando usted elige un ajuste, en el almacenamiento local de su navegador:
- «site-lang»: el idioma que eligió en esta web;
- «curso_lang» y «curso_done»: en el área del curso, el idioma elegido y los módulos que marcó como terminados.
Estas entradas solo contienen un código de idioma o una lista de identificadores de módulos, permanecen en su dispositivo y no se transmiten ni a mí ni a terceros. Son estrictamente necesarias para la función que usted pidió expresamente (mantener el idioma, recordar el avance del curso) (§ 25 apdo. 2 n.º 2 TDDDG); no requieren consentimiento. Se conservan hasta que usted borre los datos del sitio en su navegador.
4. Alojamiento y transferencia a EE. UU.
Esta web está alojada en Netlify, Inc., 512 2nd Street, Suite 200, San Francisco, CA 94107, EE. UU. Al abrir cualquier página, Netlify trata los datos de conexión técnicamente necesarios, en particular la dirección IP, la hora, la dirección solicitada, el referente y el identificador del navegador (user agent), para servir la web y protegerla de ataques. La base jurídica es el art. 6.1.f RGPD; mi interés legítimo es ofrecer una web segura y que funcione. Netlify conserva estos registros solo el tiempo necesario para esos fines.
Netlify actúa como encargado del tratamiento conforme a su contrato de encargo (art. 28 RGPD), que forma parte de sus condiciones de uso. Netlify también trata datos en EE. UU. Netlify, Inc. está certificada en el Marco de Privacidad de Datos UE-EE. UU.; la transferencia se basa en la decisión de adecuación de la Comisión Europea del 10 de julio de 2023 (art. 45 RGPD). Si esa decisión dejara de valer, el contrato de encargo incluye las cláusulas contractuales tipo de la Comisión Europea (art. 46.2.c RGPD). 5. Formularios de contacto y consulta, check de tres minutos, pregunta de ruta de DxVida
Qué se transmite. Cuando usted envía un formulario, su navegador transmite sus datos a Netlify Forms (Netlify, Inc., sección 4). Allí se guardan y yo recibo un aviso por correo (sección 7). Según el formulario, son:
- Conversación «Bring me one problem» (página de inicio y página «Lo que necesite»): nombre, correo, su consulta, número de personas implicadas, plazo deseado, el tema por el que llegó y, si antes hizo el check, su nivel y puntuación. Ambos los ve en el formulario antes de enviarlo y puede quitarlos.
- Consulta del curso (curso de IA): nombre, correo, si es para un equipo o para usted, número aproximado de personas, ubicaciones, idioma del curso y su objetivo.
- Consulta de LightenAI (carga mental): nombre, correo, su mensaje y el resultado de la calculadora (importe mensual).
- Check de tres minutos: sus ocho respuestas, nivel y puntuación, correo, de forma voluntaria su nombre, su consentimiento y si además desea la carta. Solo se transmite si usted escribe un correo y lo envía; si deja el campo vacío, nada sale de su navegador.
- Pregunta de ruta de DxVida: país de origen y de destino, categoría de producto, su rol y, solo si lo desea, su correo con su consentimiento.
Todos los formularios envían el idioma de la página; la conversación y el check envían además el enlace por el que llegó al formulario (por ejemplo, un botón de esta web o un enlace de check reenviado). Con cada envío, Netlify guarda automáticamente su dirección IP, el identificador del navegador (user agent), la dirección de la página de envío y la hora. Por favor, no escriba en los campos de texto libre nada sobre su salud ni la de otras personas; no lo necesito para responderle.
Control de spam. Netlify revisa automáticamente cada envío con el servicio Akismet de Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, EE. UU. Para ello se transmiten a Akismet los contenidos del formulario junto con la dirección IP y el identificador del navegador. La base jurídica es el art. 6.1.f RGPD; mi interés legítimo es protegerme de envíos abusivos masivos. Netlify transmite los datos a Akismet dentro de EE. UU. y está obligada por las reglas del Marco de Privacidad de Datos UE-EE. UU. para transferencias ulteriores.
Para qué y con qué base.
- Conversación, consulta del curso y consulta de LightenAI: para responder a su consulta y, si lo desea, preparar una propuesta (art. 6.1.b RGPD). Si su consulta no busca un contrato, la respuesta se basa en mi interés legítimo en responder consultas (art. 6.1.f RGPD).
- Check de tres minutos: para escribirle una vez personalmente sobre su resultado, con base en su consentimiento (art. 6.1.a RGPD).
- Pregunta de ruta de DxVida: sin correo, para ver qué rutas comerciales se piden y desarrollar DxVida en consecuencia (art. 6.1.f RGPD; interés legítimo en planificar el producto). Con correo, para escribirle cuando su ruta esté disponible en DxVida, con base en su consentimiento (art. 6.1.a RGPD).
El nombre y el correo son obligatorios en la conversación, la consulta del curso y la consulta de LightenAI, porque de lo contrario no puedo responderle; todo lo demás es voluntario. No existe obligación legal ni contractual de rellenar un formulario. No se toman decisiones automatizadas en el sentido del art. 22 RGPD; la puntuación del check la calcula su navegador y no tiene consecuencias para usted.
Cuánto tiempo. Borro las consultas y los envíos del check en Netlify y en mi buzón cuando termina la conversación, a más tardar a los doce meses. Borro las rutas con correo en cuanto le he escrito o usted retira su consentimiento, y las rutas sin correo a más tardar a los doce meses. Si una consulta se convierte en encargo, conservo la correspondencia comercial el tiempo que exigen las leyes mercantiles y fiscales (§ 257 HGB, § 147 AO; normalmente seis años para cartas comerciales).
6. La carta ocasional
Para la carta solo necesito su correo. Puede suscribirse con el formulario del pie de página o con la casilla del check de tres minutos; la base jurídica es su consentimiento (art. 6.1.a RGPD). Antes de la primera carta recibirá un correo en el que confirma su suscripción; sin confirmación no la o lo inscribo y borro la solicitud. Guardo la suscripción y la confirmación con fecha y hora para poder demostrar su consentimiento (art. 7.1 RGPD). Envío la carta desde mi buzón de correo (sección 7). Puede retirar su consentimiento en cualquier momento, con el aviso de baja que lleva cada carta o simplemente por correo. Después borro su dirección de la lista de envío; conservo la prueba de su consentimiento hasta tres años para poder defenderme de posibles reclamaciones (art. 6.1.f RGPD).
7. Correo electrónico
Los avisos de envíos de formularios, sus correos, mis respuestas y la carta pasan por mi buzón de correo en Google (Google Ireland Limited, Gordon House, Barrow Street, Dublín 4, Irlanda). Google puede transferir datos también a EE. UU.; Google LLC está certificada en el Marco de Privacidad de Datos UE-EE. UU. (art. 45 RGPD).
8. Sus derechos
Tiene derecho de acceso (art. 15 RGPD), rectificación (art. 16), supresión (art. 17), limitación del tratamiento (art. 18) y portabilidad de los datos (art. 20). Puede retirar cualquier consentimiento en cualquier momento con efecto para el futuro (art. 7.3 RGPD); el tratamiento realizado hasta entonces sigue siendo lícito. Basta un correo sin formalidades.
Derecho de oposición (art. 21 RGPD). Cuando trato datos con base en el art. 6.1.f RGPD (alojamiento, control de spam, pregunta de ruta sin correo, consultas sin relación con un contrato), puede oponerse en cualquier momento por motivos relacionados con su situación particular. Entonces dejo de tratar los datos, salvo que pueda acreditar motivos legítimos imperiosos que prevalezcan sobre sus intereses, o que el tratamiento sirva para formular, ejercer o defender reclamaciones.
Derecho a reclamar (art. 77 RGPD). Puede presentar una reclamación ante una autoridad de protección de datos, en particular en el Estado miembro donde vive o trabaja.
